Lordstown Motors Corp. has successfully defended its bankruptcy filing against Foxconn's efforts to have it dismissed. Judge Mary Walrath rejected Foxconn's allegations that the struggling electric vehicle startup had improperly sought Chapter 11 protection to gain an unfair advantage in the legal dispute over the production agreement for the Lordstown flagship brand, Endurance truck. Lordstown claimed that it had little cash left before filing for bankruptcy in June and faced significant attrition of employees and customers after Foxconn expressed its intention to exit the production partnership. In light of this, Judge Walrath deemed Lordstown's bankruptcy application justified and the company is now seeking a viable solution by exploring the sale of the company to repay its creditors.
